Allmän utveckling

Traditionell EU-politik på miljöområdet har varit att med hjälp av tekniska krav reglera olika verksamheter, t.ex. utsläpp från bilar och stora förbränningsanläggningar. De krav som ställts har sällan varit särskilt djärva, utan baserats på redan befintlig teknik.

Nya grepp togs i början av 1990-talet med det femte miljöhandlingsprogrammet och det s.k. Auto-oil programmet. I båda fall utgick man först från vissa miljömål och försökte sedan identifiera de bästa åtgärderna för att nå dem.

Detta arbetssätt har sedan tillämpats flera gånger. På initiativ från Sverige utarbetades en försurningsstrategi som presenterades av kommissionen 1997. Den utgår från det miljömål som redan 1993 slogs fast i det femte miljöhandlingsprogrammet, nämligen att det övergripande långsiktiga målet är att de kritiska belastningsgränserna för försurning inte ska överskridas någonstans i unionen. I strategin föreslogs ett delmål till år 2010 och en rad åtgärder för att nå dit.

Beträffande luftkvalitet sägs i det femte miljöhandlingsprogrammet att befolkningen inte ska utsättas för skadliga halter av luftföroreningar och att de gränsvärden som sätts också ska beakta skyddet av den övriga miljön. Eftersom marknära ozon, i likhet med försurningen, är ett gränsöverskridande problem, har EU-kommissionen också tagit fram en ozonstrategi.

Ett viktigt resultat av de båda strategierna är det s.k. takdirektivet, som antogs 2001.

Mellan 2001 och 2005 bedrevs i kommissionens regi ett mycket omfattande arbete för att knyta ihop arbetet med luftföroreningar och staka ut åtgärdsbehov för perioden 2010-2020. Detta arbete, kallat Clean Air for Europe (CAFE), resulterade i en tematisk strategi för luftföroreningar som presenterades i september 2005.

Takdirektivet

Takdirektivet är ett av EUs viktigaste direktiv för att minska utsläppen av luftföroreningar. Det innehåller mål för hur mycket försurningen och halterna marknära ozon ska minska till 2010.

För att nå målen har varje land tilldelats ett nationellt utsläppstak för de fyra föroreningarna svaveldioxid, kväveoxider, ammoniak och flyktiga organiska ämnen (de tre förstnämnda är försurande, medan kväveoxider och flyktiga organiska ämnen tillsammans bidrar till bildningen av marknära ozon).

Liksom i Göteborgsprotokollet har fördelningen av åtaganden mellan länderna räknats fram för att nå största möjliga miljövinst till lägsta samlade kostnad för EU som helhet.

Jämfört med kommissionens förslag är de utsläpptak länderna åtagit sig mycket svagare. Endast ett fåtal länder har åtagit sig mer än de redan gjort i Göteborgsprotokollet.

En revidering av takdirektivet för att ta fram utsläppstak för 2020 påbörjades hösten 2005. Ett förslag väntas från kommissionen våren 2008.

Tematisk strategi om luftföroreningar

I EUs sjätte miljöhandlingsprogram, som antogs 2002, ingick att kommissionen senast 2005 skulle lägga fram sju s.k. tematiska strategier, bl.a. om luft, hav, avfall och stadsmiljö.

Den tematiska strategin om luftföroreningar presenterades i september 2005. Den beskriver problemen och sätter upp delmål för miljökvaliteten inom unionen 2020.

Strategin innehåller inga konkreta förslag på åtgärder. Kommissionen lovade dock att återkomma med ett förslag till nytt direktiv som fastställer nationella utsläppstak för en rad luftföroreningar att uppnås till 2020 (det nuvarande takdirektivets utsläppstak ska uppnås 2010). Man förutser också hårdare krav på vägtrafiken och åtgärder mot utsläpp från mindre förbränningsanläggningar.

Samtidigt med strategin presenterade kommissionen ett förslag till nytt luftkvalitetsdirektiv, som bl.a. innehåller gränsvärden för hälsoskadliga fina partiklar (PM2.5).

Den ambitionsnivå kommissionen har valt ligger mellan vad som beskrivs som "låg" och "mellan" i det omfattande underlag som tagits fram under fyra års arbete inom det s.k. CAFE-programmet (Clean Air For Europe).

I tidigare utkast till strategi var ambitionerna högre, men påtryckningar från industrin och andra direktorat inom kommissionen tvingade miljödirektoratet till reträtt i ett sent skede.

Enligt kommissionens analys kommer strategin att resultera i vinster, framför allt genom bättre hälsa, värderade till minst 42 miljarder euro årligen 2020. Det är nästan sex gånger mer än den förväntade kostnaden, 7,1 miljarder euro per år.

Kostnaden är dock av allt att döma överskattad, bl.a. eftersom enbart tekniska åtgärder ligger till grund för kostnadsberäkningarna. Dessutom tillkommer en rad vinster som inte har någon prislapp, bl.a. en rejäl minskning av de områden där den kritiska belastningsgränsen för försurning och övergödning överskrids.

Tanken är att strategin ska revideras 2010, samtidigt som det sjätte miljöhandlingsprogrammet ses över.

Klimatpåverkande gaser

Inför klimatmötet i Kyoto 1997 var EU-ländernas förhandlingsposition att utsläppen av växthusgaser skulle minska med 15 procent från 1990 till 2010, men den minskning man åtog sig efter förhandlingar var 8 procent (trots att kommissionen visat att en minskning med 15 procent skulle vara lönsam för länderna!).

I de förhandlingar som följt på Kyotoprotokollet har EU varit en pådrivande part.

Kommissionen har lagt fram en rad strategier, program och förslag för att unionen ska klara den minskning av utsläppen med 8 procent som man åtagit sig. Mellan 1990 och 2005 uppgår minskningen dock bara till ett par procent.

Det miljömål EUs regeringschefer ställt sig bakom är att jordens medeltemperatur inte bör få stiga mer än 2 °C över förindustriell nivå. Vid toppmötet i mars 2007 beslöts att EUs utsläpp av växthusgaser ska minska med 20 procent perioden 1990-2020, eller med 30 procent om andra industrialiseade länder gör liknande åtaganden. Till 2050 bör i-ländernas utsläpp minska 60-80 procent.

Dåligt eller bra?

För att balansera den tämligen positiva bild av EUs miljöarbete som ges ovan är det befogat att även redovisa några minustecken.

  • Huvudmålet för EU är att utveckla en fri inre marknad, vilket resulterar i omfattande godstransporter.
  • Länder med låga miljöambitioner kan med framgång blockera viktiga beslut. Det har t.ex. hittills visat sig vara omöjligt att införa en gemensam skatt på utsläpp av koldioxid. Orsaken är att beslut om harmoniserade skatter kräver enighet mellan alla medlemsländer.
  • Via EUs strukturfonder (som ger stöd till de fattigaste medlemsländerna) och projektet Trans European Networks subventioneras stora investeringar i ny infrastruktur, i många fall i form av nya vägar. Även de omfattande subventionerna till jordbruket motverkar i stor utsträckning miljömålen.
  • EUs beslutsprocess är till stora delar sluten, vilket minskar möjligheten till insyn och effektivt opinionsarbete. Strukturen gynnar även de parter som är ekonomiskt starka och har möjlighet att förse kommissionen med egna utredningar och underlag.

Beslutsprocessen

När det gäller varor som kan flyttas över gränserna, t.ex. fordon och drivmedel, innebär EU-lagarna i regel harmonisering, vilket betyder att alla länder måste tillämpa samma krav. När det gäller stationära verksamheter, t.ex. kraftverk, och lokal luftkvalitet ställer EU istället vanligen minimikrav som måste uppfyllas, men där de länder som vill kan ställa strängare nationella krav.

De flesta beslut på miljöområdet inom EU fattas enligt den s.k. medbestämmandeproceduren, vilken innebär att parlamentet har lika mycket att säga till om som ministerrådet. Det gör att beslutsprocesserna kan bli ganska utdragna - ofta går det två år mellan förslag från kommissionen och slutgiltigt beslut i ministerrådet.
